Terroristic threats

I just had to make a link to this story (original here), where a man with no legs and limited use of his arms is facing criminal charges for threatening to strangle a judge over an unfavorable child support ruling. He has been charged with making terroristic threats!

My point: Why was he denied a paternity test in the first place? It should be automatic in contested cases.
